TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE OPENGRADIENT FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. IN NO EVENT SHALL THE OPENGRADIENT FOUNDATION'S TOTAL LIABILITY EXCEED TEN DOLLARS ($10 USD).

You agree to indemnify, defend, and hold harmless the OpenGradient Foundation, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or your violation of these Terms.

These Terms constitute the entire agreement between you and the OpenGradient Foundation regarding the Services and supersede all prior understandings. You may not assign your rights under these Terms. No agency, partnership, or joint venture relationship is created by these Terms. The OpenGradient Foundation's failure to enforce any provision shall not constitute a waiver of that provision. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
